Terms of use

By creating an account and using Sakalm, you accept what follows.

WHAT THE APP DOES

Sakalm records your activities and enters you each week in a group of ten people at a comparable level, brought down to six during your two placement weeks. The ranking is settled on the distance covered, or on the area taken if you chose that mode. The top two in the group move up one league, the bottom two move down one.

WHAT YOU UNDERTAKE TO DO

Record real activities, done by you, under your own power.

Not to distort a measurement, whether by faking a position, by handing your phone to someone else, or by carrying it in a vehicle.

Use one account only.

Any activity that fails the automatic check is left out of the ranking. In the event of repeated and deliberate manipulation, the account may be closed without notice.

YOUR HEALTH AND YOUR FITNESS

You choose your pace, your distances and your routes: the app decides none of it. By using Sakalm, you state that you are fit to do the physical activity you record, and you do it under your sole responsibility.

It is for you to make sure, before you start and regularly afterwards, that your state of health allows it. If you have any doubt, a history of heart trouble, ongoing treatment, a pregnancy, or simply are starting again after a long break, see a doctor before you run, not after.

The app prescribes no training, sets no target to reach, and urges no particular effort. The pace and the distance are your decisions.

The figures shown, including those with technical names such as VO2max, HRV or training load, are estimates worked out from the sensors of a phone or a connected watch. They are not medical measurements. They cannot screen for, diagnose or monitor anything, and they replace neither medical advice, nor a fitness assessment, nor a certificate of fitness.

Sakalm is not a medical device within the meaning of European Regulation 2017/745.

If you feel pain, unusual breathlessness, dizziness or faintness while exercising, stop immediately and seek advice.

LIABILITY

The app is a tool for recording and comparing. It is not with you out there and cannot judge your situation.

You alone are responsible for the choice of your routes, for obeying traffic law, for weather conditions, for your equipment and your hydration, and for your own safety and that of others during your activities.

We cannot be held liable for harm arising from your sporting practice, from the choice of a route, from an accident during an activity, or from a decision you took on the basis of a figure shown by the app.

We guarantee neither the accuracy of measurements, which depend on the GPS and the sensors of your device, nor the continuous availability of the service, nor the absence of interruption or error.

These limits apply to the fullest extent permitted by law. They are not meant to exclude liability for gross negligence or wilful misconduct, nor liability arising from harm to physical integrity: French law forbids it.

WHAT YOU POST IN THE FEED

The feed is for your friends. What you post there is visible only to the people you have accepted, and to nobody else. There is no public feed in Sakalm.

A post always rests on one of your activities. Your friends see its photo, your words, the distance, the duration and the day. Never the time, never the place, never the route.

The place and time information written inside your photo file is erased before it is sent. A photo taken at the end of a run carries the coordinates of where it was taken, so often an address.

WHAT HAS NO PLACE IN THE FEED

There is no tolerance for the following content, and an account that posts it is closed without notice:

Nudity, sexual content, pornographic content.

Any image showing a minor in a sexual or degrading context, however it is presented. This is also reported to the authorities.

Violence, cruelty, content meant to shock.

Hatred, harassment, threats, content targeting a person or a group because of their origin, their religion, their disability, their sex or their orientation.

Someone else’s photo posted without their agreement. In France, everyone holds a right over their own image: a recognisable person in your photo must have agreed to your posting it.

An image that is not yours and that you have no right to distribute.

REPORTING, BLOCKING

Every post carries a report button. A reported post disappears from your feed immediately, before I have even read it, and I decide within twenty-four hours.

You can block anyone from their post. You will no longer see each other, in either direction.

WHAT YOU KEEP

Your activities belong to you. You can export them whenever you want, in a format readable elsewhere. We claim no ownership of them and we do not use them for anything other than the service.

DELETION

You can delete your account from the app, at any time, without having to justify it. It is final.

We may close an account that cheats repeatedly, or that harms other members.

SUSPENDING AN ACCOUNT

An account is suspended when cheating is repeated and deliberate, or when forbidden content has been posted. The decision is always taken by a person, after review: the automatic check on activities never suspends anyone, it judges one activity at a time.

A suspended account can no longer write anything: it cannot record an activity, import from a watch, declare steps, enter a challenge, open a chest, or request payment of referral earnings.

It does keep access to its history, to the export of its data and to the deletion of the account. A penalty in the game deprives nobody of their rights over their own data.

A suspension is disputed by email to hello@sakalm.com. We reply within fifteen days, and we give the reason.

THE BETA

The app is under development. It may contain errors, lose data, or change without notice. It is provided as is, free of charge, with no guarantee of result.

NO PRIZE IS AWARDED during this phase. And nothing can be bought in the app: no subscription, no Race Number, no Goldi, nothing at all.

At public launch, a weekly prize will be at stake and a paid subscription will be offered. Neither will change the rule of the ranking: the prize will go to whoever finishes first in the group on distance, and the subscription will give no advantage. The challenge rules set this out in detail, and they can be read right now.

These changes will give rise to a new version of these terms, which the app will ask you to accept.

REFERRALS

The app offers a referral scheme. It is optional, free, and it follows separate rules, readable in the app and on the site. In summary, and these points are not negotiable:

It is reserved for people aged 18 or over. A paid scheme creates tax obligations, and you do not commit to one alone while you are a minor.

The referrer receives 30% of the price actually paid by the person they referred on their FIRST Premium subscription, tax included, and once only per person referred. Renewals, later subscriptions and shop purchases earn nothing.

The person referred receives a welcome gift when they have recorded their first activity, and not before: not by installing the app, nor by creating an account. This gift is never paid for, in any form.

An earning may be cancelled for 180 days after the payment, and only in three cases: a refund obtained from Apple or Google, a payment disputed with a bank, or established fraud. After that it is definitively acquired. An earning cancelled after payment is deducted from earnings to come: no sum is ever claimed back from a referrer.

The sums received are taxable income which the referrer declares themselves. Above EUR 2,400 received in a single calendar year, the law requires us to report them to the tax authorities, and we then ask for the referrer’s full name and postal address.

A code shared publicly, on a social network or in front of an audience, is a paid recommendation: the law then requires you to state clearly that it is a partnership. Sent by private message to people you know, it calls for no such statement.

IF YOU INSTALLED SAKALM FROM APPLE’S APP STORE

This section is required by Apple, and it takes nothing away from what comes before.

This agreement is between you and Sakalm, and with nobody else. Apple is not a party to it. Sakalm alone is responsible for the app, its content and how it works.

The app is licensed to you for personal, non-transferable use on the Apple devices you own or control, under the Usage Rules of the App Store, family sharing included.

Support and maintenance are provided by Sakalm alone, at hello@sakalm.com. Apple has no obligation on that front.

If the app does not work as announced, Apple may refund the purchase price, if there was one. Beyond that refund, Apple gives no warranty. Any other claim, any request for compensation and any question of conformity, product safety or product liability is a matter for Sakalm.

If a third party considers that the app infringes their intellectual property rights, Sakalm answers, defends and bears the settlement.

By using the app you represent that you are not located in a country under a United States embargo and that you are not on any United States list of prohibited parties, a representation Apple asks all its developers to include.

The name, address and contact address of the publisher appear in the legal notice, which is one of the documents you accept.

The third-party services the app gives access to are subject to their own terms, and Sakalm undertakes to comply with them.

Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement. By accepting it, you acknowledge that Apple may enforce it directly against you.

GOVERNING LAW

French law. In the event of a dispute, we first look for an amicable solution in writing. Failing agreement, you may use a consumer mediator free of charge before any court action.

This is a translation, provided for convenience. Sakalm is published in France and its obligations are written in French. Where the two versions differ, the French version prevails.
